The effects of national cultures on two technologically advanced countries: The case of e-leadership in South Korea and the United States

The increased use of information and communication technologies (ICTs) has triggered enormous innovation in the public sector and created positive public value at the managerial, delivery of services, and policy levels. However, these positive outcomes do not automatically accrue simply by adoption of ICTs as public leaders can fail to adopt relevant new ICTs, use them poorly, or use them in ways that actually diminish public value, which raises the question of the importance of e-leadership. This article examines e-leadership and innovation capacity at the individual public manager level and fills in some gaps about the practice and implementation of ICTs in the public sector. We explore eight research questions useful in theorizing about e-leadership, develop constructs of e-leadership, and describe the current development of e-leadership. By comparing e-leadership in two country settings (South Korea and the United States), we also overcome the limitations of the existing Western-oriented studies about innovations in the public sector. In addition to the growth of e-leadership use and requirements for a variety of competencies equivalent to, but separate from, traditional communication competences, we find that national cultures exert significant influence on the major constructs of e-leadership, which implies that an effective e-leadership strategy should consider cultural contexts seriously.     

Fluorescence of a Natural Fluorophore as a Key to Improve Fingerprint Contrast Image

The optical and morphological properties of resveratrol were investigated. This nontoxic fluorescent natural material, emitting in the visible blue light, was used as an optical marker, enabling the enhancement of the image contrast coming from relief pictures marked on challenging surfaces. By applying appropriated imaging softwares, this marker was verified to be very useful in the latent fingerprint recognition deposited on different wood surface types, mainly those with high level of roughness, where conventional forensic materials do not allow effective fingerprint image visualization.     

Adding to the Controversy? Civil Society’s Evaluation of the National Conference Dialogue in Yemen

ABSTRACT

This article assembles a picture of Yemen’s 2013–14 National Dialogue Conference (NDC) by collecting perspectives from local civil society organizations (CSOs), which are contrasted to the views of international commentators. Despite all efforts by internal parties as well as the international community, the dialogue failed to avert war, which broke out shortly after. Through interviews with 50 CSOs, we reconstructed the reasons for failure, as well as paying attention to the observed strengths of the dialogue. Half of the consulted organizations were directly involved in the NDC, either as an invited participant or in a brokerage role. The other half concerns outside observers. We identify aspects on which the opinion of the CSOs converge, but also highlight striking divergences depending on insider/outsider status. In contrast to the view espoused in the international literature, the CSOs overall feel that, in spite of all its procedural and substantive flaws, the NDC was a significant junction in the long road towards peace and stability and laid important groundwork for future dialogues.     

“韦伯命题”之争及其启示

上世纪初,韦伯提出并论证了韦伯命题——中国司法属于非形式主义的卡迪司法。近百年以后,中国大陆就这一命题的真伪进行了长达10多年的高水准学术论辩。如果正确理解了韦伯社会学思想的核心概念——理想类型——及其衍生的卡迪司法的真谛,并运用整体的观念来评价中国司法,则韦伯命题的成立是无可置疑的,否定论者所列举的实证材料,并不是韦伯立论的基点。韦伯命题之争有复杂的时代背景,它的背后涉及法律文化是否存在普适性价值、不同时空中的法律文化是否存在可比性、如何客观认知和理性对待本族法律文化传统、法律现代化是否可欲及其价值取向等重大的法理问题,特别是对形式主义司法的认知与评价这一重大的司法哲学问题。这些与中国司法未来走向息息相关的时代性问题都值得法学界认真对待。     

动力灸治疗肝肾亏虚型膝骨关节炎疗效观察

目的 观察动力灸治疗肝肾亏虚型膝骨关节炎（knee osteoarthritis ，KOA）的临床疗效。方法 将符合纳入标准的60例肝肾亏虚型KOA患者随机分为试验组与对照组，每组30例。试验组给予动力灸治疗，对照组予以普通针刺治疗，两组均每天治疗1次，连续治疗21 d为1个疗程。1个疗程结束后比较两组患者治疗前后视觉模拟量表（visual analogue scale，VAS）评分、西安大略和麦克马斯特大学骨关节炎指数（the Westem Ontario and McMaster Universities Osteoarthritis Index, WOMAC）、中医证候评分及临床疗效，并记录两组不良反应情况。结果 治疗后两组患者VAS评分、WOMAC评分、中医证候评分较治疗前均明显改善（P<0.05），且试验组改善程度明显优于对照组（P<0.05）；试验组临床疗效明显优于对照组（P＜0.05）。对照组有1例患者出现晕针情况，而试验组患者均未出现不良反应。结论 动力灸治疗肝肾亏虚型KOA疗效确切，不良反应少，能有效地缓解膝关节疼痛，改善患者的生活质量。     

司法改革方法论的反思性整合——一个实践理性的视角

在全面依法治国的时代背景下,司法改革的推进需要在实践理性的指导下,通过新的方法论体系来予以重新解读和把握。当下司法改革的方法论面临价值理性缺失、工具理性误区和理论范式失衡的现实困境,需要在问题导向的基础上,借鉴和利用多种社会科学方法,透过多种视角探讨如何认识改革、如何推进改革、如何评价改革,在实践建构中实现方法体系的反思性整合。以"制度化的社会回应型司法"为基本目标,协调价值理性与工具理性的冲突,统合国家治理的实践逻辑与法治的价值逻辑,统筹推进司法制度的改革和构建。     

Symbolic Political Communication,and Trust: A Young Voters’ Perspective of the Indonesian Presidential Election

Communication in political marketing plays an important role in political mobilization, building trust both in political actors and the government. Politicians construct their messages through careful branding as the power of the cultural symbols and signs conveyed through the brand are potent heuristic devices. This is particularly important in emerging democracies, where there is limited political knowledge and understanding. Therefore, this research explores how young voters understand the symbolic communication fashioned by political actors in Indonesia and how it relates to their brand. Indonesia is an interesting area for study; it is both secular and the world’s largest Muslim democracy. Using a phenomenological approach, a total of 19 in-depth interviews with young voters were conducted to gain rich insight into perceptions of the complexity of political symbolism, and trust among young voters. This study conceptualized political communication as a dual approach. The political brand promise is intrinsically linked to cultural references and conveyed through symbolic communication combined with a distinctive brand message. This builds trust, which then affects political participation. This conceptual framework provides insights into the importance of culture in branding which has implications for policy makers and actors in emerging and established democracies.     

专业学会在应对突发公共卫生事件中的作用——以新型冠状病毒肺炎疫情应对为例

与一般危机事件相比,突发公共卫生事件具有突发性、高度专业性、未知性、群体性、社会性以及应对协同性等特征。在现代化治理体系中,专业学会作为突发公共卫生事件应急管理的重要补充力量,应当发挥专业优势、组织协调优势、凝聚精神等优势,在疾病的预测、健康科普、组织动员、心理干预等方面发挥积极作用。     

论动产所有权让与中的交付

动产所有权让与中的交付,又称动产所有权出让或转让中的占有的移转,其既为动产所有权让与的公示方法,也通常为动产所有权让与发生物权变动效力的要件,类型上涵括现实交付、观念交付及其他特殊形态的交付。我国民法典物权编对于此等交付的厘定(规定)较为简略或存有阙如,宜结合域外立法成例、法理或学理而予阐释、厘清及释明。透过如是的工作和努力,期冀可以建构起我国动产所有权让与中交付规则或制度的解释论("注释论""评注论")系统,由此使这一规则或制度可裨益于我国的社会生活与经济实践,并进而发挥其具有的积极功用与价值。     

行动者“漏斗效应”:党内法规执行问题的解释框架

党内法规能否执行到位,关系到党要管党、全面从严治党的重大战略部署,关系到良好政治生态的形成和党的长期执政能力建设等重要议题。究竟是哪些因素影响党内法规的有效执行,本研究选择《中国共产党巡视工作条例》《干部教育培训工作条例》《中共中央关于加强社会主义协商民主建设的意见》在T省的执行案例作为研究对象,遵循扎根理论的研究逻辑,直接从经验材料入手,不断归纳、对比和提炼,提出"行动者‘漏斗效应’"的解释框架。党内法规执行的行动者受认知共同体、制度协同性、激励与约束与行动者知识的因素制约,呈现层层失守的执行损耗。
